Hikvision Takes Legal Action Against FCC's Chinese Gear Restrictions

In a significant legal challenge, Hikvision's U.S. branch has announced it is contesting recent Federal Communications Commission (FCC) regulations that impose stricter controls on Chinese-manufactured telecommunications devices. This rule is designed to address national security issues by prohibiting new approvals for equipment containing components from firms on the FCC's “Covered List” while also allowing the revocation of existing permissions.

Hikvision claims the FCC has overstepped its boundaries by attempting to retroactively override valid authorizations. The company's petition is intended to protect its rights in the market and foster a more stable regulatory framework for compliant businesses and consumers.

The FCC's Covered List includes Hikvision along with other major names like Huawei and ZTE, restricting these companies from obtaining new U.S. import or sales clearances. Recently, several major e-commerce platforms have purged millions of items—from home security cameras to smartwatches—from these manufacturers because of the new regulations.

This isn’t Hikvision's first encounter with regulatory challenges in the U.S.; earlier this year, a court dismissed its efforts to reverse a ban on its video surveillance and telecom equipment from 2022. The FCC has broadened its scrutiny to other firms, including Hong Kong's HKT, under the ongoing national security discourse, indicating a significant increase in the examination of foreign telecom companies.

Hikvision asserts that this legal initiative is focused on ensuring market stability and defending the interests of its partners and customers amidst a shifting regulatory environment.
