Danny Masterson Argues Lawyer's Errors Led to Rape Convictions

Former actor Danny Masterson, known for his role in That ’70s Show, is contesting his 2023 rape convictions, attributing the blame to his defense attorney for inadequate representation.

At 49, Masterson is currently facing a sentence of 30 years to life for the assault of two women. Recently, he filed a habeas corpus petition, asserting that attorney Philip Cohen neglected to summon potential witnesses or effectively counter the prosecution's arguments concerning Scientology.

The petition reveals Masterson's insistence for Cohen to gather evidence, yet his lawyer only engaged with two of over 20 witnesses who had previously provided supporting statements. This perceived neglect constitutes a “failure of due diligence”, infringing on Masterson’s Sixth Amendment rights.

Additionally, the petition claims that bias against Scientology skewed the trial proceedings. Leah Remini, a former member, publicly sided with the accusers and allegedly acted as an advisor to the prosecution, motivated by a personal animosity.

Masterson faced convictions on two counts of forcible rape during a retrial in May 2023, following a mistrial in 2022 where the jury could not reach a unanimous decision. Prosecutors portrayed him as a habitual offender shielded by church authorities, a claim that the Church of Scientology refutes.

Masterson’s appellate lawyer, Eric Multhaup, expressed that the jury was presented with only partial information, neglecting critical exculpatory evidence. The habeas petition includes 65 exhibits that may have influenced the jury's decisions—evidence his team argues was overlooked.

His legal team insists this action is a pivotal step towards obtaining a new trial and achieving “complete exoneration.”
